Legal Texts for Your Online Shop in Spain

Legal texts copied from another website leave you defenceless exactly when a customer complains.

We draft and review the legal notice, general terms and conditions of sale, privacy policy, cookie policy and returns policy of your online shop, in line with Spain’s e-commerce law (LSSI), Spanish consumer law, the GDPR and the EU rules that apply from 2026.

Request a free initial assessment. We will review your shop’s legal texts, tell you what is missing or contradicts the law and give you a plan to bring them up to date.

    LEGAL SERVICES FOR ONLINE SHOPS

Which Texts Does Your Shop Need?

The legal texts of an online shop are the information and conditions the law requires you to show customers before, during and after the purchase. These are the ones we draft and review.

We draft the legal notice with the identification required by Article 10 of the LSSI and general terms and conditions that cover the checkout process, payments, delivery times and costs, and the pre-contractual information required by Article 97 of Spanish consumer law.

We prepare a layered privacy policy, form notices, a cookie policy and the consent banner, with a clear legal basis for each processing operation, such as orders, the newsletter, offers to customers, abandoned carts and analytics.

We organise the 14-day right of withdrawal and its form, the exceptions, refunds and the three-year legal guarantee, and we add the harmonised guarantee notice and, if your catalogue has it, the producer’s durability label.

We review how you advertise prices and discounts, how you publish and verify reviews and what you say about your products. Claims such as «eco-friendly» or «sustainable» and your own labels are subject to new rules under Directive (EU) 2024/825.

If you sell on Amazon, on other marketplaces and in your own shop at the same time, we adapt your terms to each channel and review the data and documents each platform requires from you as a trader.

Thank you so much, Marta, for your invaluable advice. Without your knowledge of NFT technology in the art market, a new and promising field but one exposed to a lot of fraud, I would have got myself into serious trouble. Marta …

    REGULATORY FRAMEWORK

Which Rules the Legal Texts of an Online Shop Must Reflect

The legal texts of an online shop respond to several rules at once. Spain’s Law 34/2002 on information society services (LSSI) requires the website owner to be identified, governs electronic contracting and commercial emails and requires consent for non-essential cookies. Spain’s General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007) sets the pre-contractual information for distance sales, the 14-day right of withdrawal and a three-year legal guarantee for new goods, under its Article 120.

From 27 September 2026, Implementing Regulation (EU) 2025/1960 applies, setting the design of the harmonised guarantee notice required by Directive (EU) 2024/825, which Spain has not yet transposed. We explain it in our article on the harmonised guarantee notice for online shops. The General Data Protection Regulation decides which legal basis each use of your customers’ data needs, as we set out in our guide to GDPR for online shops. If you act as an intermediary between sellers and consumers, the Digital Services Act (DSA) adds transparency and trader traceability obligations. You will find the whole picture in our guide to e-commerce regulations in Spain.

    FAQ

Frequently Asked Questions on Legal Texts for Online Shops

The legal notice identifies the website owner with its name or company name, tax ID, address, contact email and, where applicable, registration details, as required by Article 10 of the LSSI. The general terms and conditions govern the purchase, from how the order is formed to prices, payments, delivery times and costs, withdrawal and legal guarantees. They are different documents and an online shop needs both.

Three years from delivery for new goods, under Article 120.1 of Spanish consumer law. For digital content and services it is two years, and for second-hand goods a shorter period may be agreed, never less than one year. If your terms say two years for new products, they contradict Spanish law.

Only if you can prove it and specify it on the same medium. Directive (EU) 2024/825 treats as unfair in all circumstances generic environmental claims without recognised excellent environmental performance and sustainability labels without a certification scheme. Spain has not yet transposed it, but it is worth reviewing product pages, banners and collection names now.

Usually yes. The privacy and cookie policies name the providers that process data and where they store it, and the terms of sale describe the payment methods. A change of platform or gateway usually requires updating the texts and the data processing agreements.

Only in part. The platform has its own terms, but towards the consumer you are still the seller, with your identification, your returns policy and your legal guarantee. In addition, the Digital Services Act requires marketplaces to collect and verify their sellers’ details before letting them sell.

Your shop’s address, your current legal texts if you have them, the platform and payment gateway you use, the countries you sell to and the providers that access customer data, such as email marketing or logistics. With that we prepare the free initial assessment.
